EULA For StressBook

Although all clauses contained in this agreement are standard clauses for software products, we recommend that you read this End-User License Agreement carefully before using StressBook.

This End-User License Agreement (“EULA”) is an agreement between you and StressBook, herein referred to as the “Owner,” regarding the StressBook application for iPhone and Apple Watch, herein referred to as the “Software Product,” “Software,” or “App.”

By downloading, installing, accessing, or using StressBook, you agree to be bound by this EULA. If you do not agree to the terms of this EULA, please do not install, access, or use the Software.

1. License

The Software is licensed, not sold. Subject to your compliance with this EULA, the Owner grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Software for your personal, non-commercial use on Apple-branded devices that you own or control, or as otherwise permitted by Apple’s applicable terms and conditions.

No title, ownership, or intellectual property rights in the Software are transferred to you. All rights not expressly granted under this EULA are reserved by the Owner.

2. Restrictions of Use

You may not:

  • copy, distribute, rent, lease, lend, sell, resell, sublicense, assign, or otherwise transfer the Software or this license;
  • decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works based on the Software, except to the extent such restriction is prohibited by applicable law;
  • use the Software for any unlawful, harmful, fraudulent, or unauthorized purpose;
  • interfere with or disrupt the operation, security, or integrity of the Software;
  • remove, obscure, or alter any copyright, trademark, or proprietary notices contained in or displayed by the Software.

Any attempt to do so is void and may result in termination of your right to use the Software.

3. Intellectual Property

You acknowledge and agree that the Software, including but not limited to its design, features, code, text, graphics, interface, trademarks, logos, and other content, is owned by the Owner or its licensors and is protected by copyright, trademark, and other applicable intellectual property laws.

You do not acquire any ownership rights in the Software by downloading, installing, or using it.

4. Health and Wellness Disclaimer

StressBook may provide wellness-related information, including but not limited to heart rate variability, stress estimation, breathing guidance, hydration reminders, activity-related insights, and other health-related data or interpretations.

StressBook is intended for general wellness and informational purposes only. It is not a medical device and is not intended to diagnose, treat, cure, monitor, or prevent any disease or medical condition. The information provided by StressBook should not be considered medical advice.

You should always consult a qualified healthcare professional before making any medical decisions or if you have concerns about your health. Do not disregard professional medical advice or delay seeking it because of information provided by the Software.

5. Subscriptions and Paid Features

StressBook may offer free features, one-time purchases, and auto-renewable subscriptions, including monthly and annual membership plans.

Subscription plans may provide access to premium features, advanced data views, additional customization options, ongoing updates, or other paid functionality as described in the App at the time of purchase.

The available subscription options may include, but are not limited to:

  • StressBook Monthly Membership: an auto-renewable monthly subscription.
  • StressBook Annual Membership: an auto-renewable yearly subscription.

The exact price, subscription duration, and included features will be clearly displayed in the App before you confirm your purchase. Prices may vary by country or region and may be subject to applicable taxes.

6. Auto-Renewal

If you purchase an auto-renewable subscription, payment will be charged to your Apple Account at confirmation of purchase.

Your subscription will automatically renew at the end of each subscription period unless you cancel it before the renewal date in accordance with Apple’s subscription management rules. Renewal charges will be made through your Apple Account using the payment method associated with that account.

You can manage or cancel your subscription through your Apple Account subscription settings, the App Store, or the system-provided subscription management interface where available.

Deleting the App does not automatically cancel your subscription. To stop future renewal charges, you must cancel the subscription through Apple’s subscription management system.

7. Refunds

All purchases and subscriptions made through the App Store are processed by Apple.

In accordance with Apple’s requirements and App Store payment rules, the Owner does not have the ability to directly issue refunds for App Store purchases or subscriptions. If you would like to request a refund, you must contact Apple Support or submit a refund request through Apple’s official refund process.

Refund eligibility and refund decisions are determined by Apple and may vary by country or region, applicable law, and Apple’s policies.

8. Changes to Subscription Plans and Pricing

The Owner may modify, add, or remove paid features, subscription plans, or pricing from time to time. Any price changes or subscription changes will be handled in accordance with Apple’s applicable rules and will be shown to you where required before taking effect.

If you do not agree to a subscription change, you may cancel your subscription through your Apple Account subscription settings.

9. Updates and Changes to the Software

The Owner may provide updates, improvements, bug fixes, new features, or changes to the Software from time to time. Some updates may be required for the Software to continue functioning properly.

The Owner may modify, suspend, or discontinue certain features of the Software at any time, with or without notice, subject to applicable law and App Store rules.

10. Privacy

Your use of StressBook is also governed by our Privacy Policy. Please review the Privacy Policy to understand how information may be collected, used, and protected.

If StressBook accesses Apple Health, HealthKit, or other health-related data, such access will only occur with your permission through the system authorization process. You may manage or revoke permissions at any time through your device settings.

11. Disclaimer of Warranty

The Software is provided “AS IS” and “AS AVAILABLE,” without warranty of any kind.

To the fullest extent permitted by applicable law, the Owner disclaims all express, implied, or statutory warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, and non-infringement.

The Owner does not warrant that the Software will be uninterrupted, error-free, secure, accurate, or free of defects, or that any information provided by the Software will meet your expectations or requirements.

12. Limitation of Liability

To the fullest extent permitted by applicable law, the Owner shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of data, loss of profits, loss of use, business interruption, or personal injury arising out of or related to your use of or inability to use the Software.

Your sole remedy for dissatisfaction with the Software is to stop using the Software and, where applicable, cancel any active subscription through Apple’s subscription management system.

13. Termination

This EULA is effective until terminated.

Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must stop using the Software and delete all copies of the Software in your possession or control.

Termination of this EULA does not automatically cancel any active subscription. You are responsible for canceling your subscription through Apple’s subscription management system if you wish to stop future renewals.

14. Third-Party Services

The Software may integrate with Apple services, including but not limited to App Store, Apple Health, HealthKit, iCloud, or other system services. Your use of such third-party services may be subject to their respective terms, policies, and settings.

The Owner is not responsible for third-party services, data availability, interruptions, or changes made by third-party providers.

15. Changes to This EULA

The Owner may update this EULA from time to time. When changes are made, the “Last Updated” date at the top of this document will be revised.

Your continued use of the Software after the updated EULA becomes available constitutes your acceptance of the revised terms. If you do not agree to the updated EULA, you should stop using the Software and, if applicable, cancel your subscription through Apple’s subscription management system.
